HOW TO START?

It is very, very possible, and do-able, to hold the violators (collection
agencies, creditors and the attorneys for both) accountable for violating the
protection laws we have in place.  Not only can you rely on the protections
afforded by the
Fair Debt Collections Practice Act (FDCPA), but also the Fair
Credit Reporting Act (FCRA).  They tools in a strong arsenal protecting our
rights.  You can also file claim of defamation, in almost every case.  Off the
bat, the first thing you want to do is preserve and create your evidence of
what they are doing to you.  

For instance, if you have witnesses to the harassment then take notarized
statements from those witnesses to back up your contentions. Be sure to
use your right to sendt the collection agency or attorney a validation of debt
request (as per FDCPA), and do it by certified mail, return receipt requested.
 If they never responded, then you have the certified receipt with the
person's signature to prove you asked. Such paper trails can make the
difference between winning and losing so document everything. No matter
how many letters, faxes, emails or phone calls you made, take time to
include copies of your phone bills, emails or fax confirmations so that you
can quickly show the judge the agency's neglect and your good faith attempt
to clear up the problem.   

There are specific law and sections of the code you can sue under, in
federal or state and small claims court.  You can file on your own or use an
attorney, and there are provisions that can allow for attorneys fees under
several circumstances, so certainly demand same if that is the avenue you
choose.  But to be sure, you can get a nice award against the violating party
if you do your homework on your valid case.  If you would like a layman's
